In accordance with Section 1829, Paragraph 1 of the Civil Code, consumers have the right to withdraw from the contract within 14 days of receiving the goods. The Seller, prioritizing consumer convenience, has decided to extend this period in the Store to 30 days. The consumer therefore has the right to return the goods without stating a reason and without any penalty.
If the buyer-consumer decides to exercise this right, it is sufficient to send the withdrawal from the contract to the seller before the expiry of the relevant period – GAPI Sp. z o.o., ul. Hoża 86/410, 00-682 Warszawa, Poland.
Furthermore, the buyer-consumer is obliged, within 14 days of withdrawing from the contract, to return the goods received under the contract to the seller in an undamaged and complete condition (including accessories, warranty card, instructions, etc.).
The buyer may also withdraw from the contract before the goods are dispatched – by email to [email protected]. The consumer may use the sample form provided in these Terms and Conditions for withdrawal.
In case of withdrawal from the contract, the buyer-consumer shall bear the costs associated with the return of the goods, in accordance with the provision of Section 1820, Paragraph 1, Letter g).
If the consumer withdraws from the contract, the seller shall return the payment to him without undue delay, no later than 14 days from the date of receipt of the notice of withdrawal from the contract.
For returning payments, the seller shall use the same payment method that the consumer used for the initial transaction, unless the consumer has expressly stated otherwise and provided that no additional costs are incurred by the seller. However, the seller shall return the payment only after receiving the returned goods or if the consumer proves that the goods have been sent back, whichever occurs first.
The buyer is only liable to the seller for any diminished value of the goods resulting from the handling of the goods other than what is necessary to ascertain the nature, characteristics, and functionality of the goods.
